These terms and conditions are entered into by and between You and Zumigo (‘Zumigo’,’we,’ or ‘us’). The following terms and conditions govern your access to and use of Zumigo.pet (the ‘Website’), and/or the Zumigo applications (also known as the ‘Mobile Application’ or Web Application) (together, or individually, the ‘Platform’ or the ‘Service’) including any content, functionality, and services offered on or through the Website or our Mobile Application, whether as a guest or a registered user. Please read these Terms and Conditions (‘Terms’) carefully before using the Website. By using the Website, using the Service, creating an account, or by clicking to accept or agree to the Terms and Conditions when this option is made available to you, you accept and agree to be bound and abide by these Terms and Conditions. If you do not want to agree with these Terms, then you are not permitted to access the Platform.

Modifications to these Terms and Conditions

We reserve the right to change these Terms at any time. Updated versions of the Terms will appear on the Platform and are effective immediately upon publication on the Platform. Your continued use of the Platform after any update constitutes your agreement to be bound by the updated Terms. You are responsible for regularly reviewing the Terms.

Zumigo Veterinary Services

Mobile and Virtual Veterinary Services Zumigo is a mobile and virtual veterinary practice, specializing in the care of domestic pets. That is to say, we provide veterinary services on-site at your premises or online through telemedicine (also referred to as telehealth). Consultations are typically performed in your home. We have the equipment and ability to perform most veterinary treatments. However, at the moment we are not a veterinary hospital and do not have the associated physical facilities to treat pets requiring extended hospitalization. If you are happy with these limitations, we are happy to accommodate your pet’s needs as best we can.

Informed Consent for Telehealth Pet Visits

  • Telehealth is the delivery of veterinary care services using interactive audio and video technology, where the patient and the veterinary professional are not in the same physical location. The telehealth services you receive from your veterinarian are not intended to replace a veterinary client-patient relationship or be the means for permanent veterinary care for your pet. As with any online health service, there are potential risks associated with its use. When using these services, you understand the additional risks of telehealth and waive any liability on the part of Zumigo or any veterinarian, veterinary technician, or other employee of Zumigo. These risks include but may not be limited to the following: information transmitted may not be sufficient (e.g. poor resolution of images) to allow for appropriate healthcare decision-making by the veterinarian; delays in evaluation or treatment due to failures of the electronic equipment; an incomplete or inaccurate diagnosis of your pet. IF YOUR PET IS EXPERIENCING AN EMERGENCY, YOU SHOULD VISIT AN EMERGENCY ROOM. DO NOT USE OUR PLATFORM WHEN YOUR PET IS HAVING AN EMERGENCY.
  • By accepting these Terms of Use, you acknowledge that you understand and agree with the following: you may expect benefits from the use of telehealth, but results cannot be guaranteed or assured. In some instances, your veterinarian may determine that telehealth services are not appropriate for some or all of your pet’s treatment needs, and accordingly may elect not to provide telehealth services to you. In the event a home visit is requested, your veterinarian will charge you for services rendered through Zumigo in-home pet care services.

Medications

We cannot supply a medication that requires a prescription without first seeing your pet. Repeat prescriptions can only be given if the pet is in the care and attention of one of our attending veterinarians, and we reserve the right in certain circumstances to re-examine your pet again before prescribing. All prescriptions must be paid for in advance. Please note that Telemedicine, the remote diagnosis and treatment of conditions for a specific pet, is only permitted for pet owners where there is an existing veterinary-client relationship (VCPR) – and thereby does allow for Zumigo to provide prescriptions online. On the other hand, for pet owners without an existing VCPR, such as in situations where general veterinary advice is being dispensed or triage assistance is being rendered, Zumigo cannot provide prescriptions online.

Important Note on General Queries

We are unfortunately unable to answer queries made by owners whose pets are not under our veterinary care. We suggest that you discuss your concerns with your vet. They are in the best position to advise you.

Treatment and Records

Subject to our professional duties as veterinary medical professionals, we reserve the right to make final decisions on treatment. We retain the responsibility for case records, including radiographs, ultrasound scans, and similar documents. Although we charge you for the taking of such radiographs and scans, and the subsequent diagnoses and advice, we retain ownership of them. In appropriate circumstances, copies can be forwarded to another veterinarian.

Service Limitations

We reserve the right, but are not obligated, to limit the offering of our services to any person, or in any geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any services that we offer. We reserve the right to discontinue any services at any time. Any offer for any services made on this site is void where prohibited by law. We do not warrant that the quality of any services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the services will be corrected.

We further manage our payments through Square Payments. Information necessary to complete payout includes name, email, phone number, address, date of birth, routing number, and account number. If you make any payments through Zumigo, you will have the option of saving your payment information to speed up future payments. Payment information is not stored in the Zumigo database but is securely stored using the third-party service Square Payments. Square Payments’ Terms of Use and Privacy Policy govern how they use this personal information.

Cookies and Other Tracking Technologies

We may set and access cookies on your computer or mobile device when you use Zumigo. ‘Cookies’ are small computer files transferred to your computing device that contain information such as user ID, user preferences, lists of pages visited and activities conducted while using the Services. We also use cookies to provide statistical information on site usage and personalize and enhance the online experience. Some of these cookies may be active during the time you are viewing a website (“session cookies”). Other cookies may remain on your computer after you have closed your browser or turned off your computer (“persistent cookies”). We may use tracking cookies on other websites, such as to serve you with targeted ads.

The following is a description of the types of cookies used on the Website:

This Privacy Policy does not cover the use of cookies used by third parties, and we are not responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Site.

How We Use Your Personal Information

Your personal information is primarily used for the creation of a Zumigo user account profile and to enable you to access the Services. We also use your personal information to:

  • Provide you with information you request, and respond to correspondence that we receive from you;
  • Provide, maintain, administer, or expand the Services, perform business analysis, or for other internal purposes, to support, improve, or enhance our business, Zumigo, and other products and services we offer;
  • Send you information about Zumigo and our Services;
  • Contact you when necessary or requested;
  • Customize and tailor your experience of the Services;
  • Send marketing or promotional emails and other communications that display content that we think will interest you according to your preferences; or
  • Prevent, detect, and investigate security breaches and potentially illegal or prohibited activities

As part of this process, we may anonymize and aggregate some of your personal information to perform certain data analysis and may display this information publicly or provide it to others. We make sure that anonymized and aggregated information is not identifiable to any particular user.
